Music: The "Nevermind" Baby Lost His Child Pornography Lawsuit!

The "Nevermind" Baby Lost His Child Pornography Lawsuit Against Nirvana

The naked baby on the cover of Nirvana's "Nevermind" album is NOT child pornography. That's according to a federal judge, who dismissed a lawsuit filed by that naked baby.

Spencer Elden, who's 34 now, had sued Nirvana, claiming he was the victim of child sexual abuse when he was photographed for that cover as a four-month-old.

But the judge said, quote, "Neither the pose, focal point, setting nor overall context suggest the album cover features sexually explicit conduct."

The judge added that Elden has financially benefitted from being the "Nevermind" cover baby . . . including being paid to recreate it and selling autographed memorabilia. He also has the album title tattooed on his chest.

An attorney for the band says his clients are delighted to be, quote, "free of the stigma of false allegations."
