Public Schools Might Ban Chocolate Milk

 

 

 Here's the only story your 10-year-old will care about today.  There might be a CHOCOLATE MILK BAN coming.

 

 

According to "The Wall Street Journal," the Department of Agriculture is considering removing chocolate milk from public school cafeterias and all other flavored milks.  They have more sugar, so that's why.

 

 

People in favor of a ban say it could keep kids healthy and lower rates of childhood diabetes.

 

 

People against it say chocolate milk is still a net benefit because of all the calcium, potassium, and vitamin D.  And if their only option is regular milk, kids might not drink it at all.

 

 

High schools would still be allowed to have it.  Just elementary and middle schools wouldn't.  But they're supposedly considering two different options . . .

 

 

One would be a full ban.  The other would limit the amount of added sugar allowed.  (In other words, they could still hand out BAD chocolate milk.)

 

 

Some cities have already done this on their own, by the way.  For example, Boston took chocolate milk off its cafeteria menus a while back.

 

 

Also, a ban like this wouldn't actually be unprecedented.  The federal government already banned whole milk AND 2% milk back in 2010.

Taco Bell Is Going After Taco John's for Their "Taco Tuesday" Trademark

 

 

This is a bit of a David and Goliath story.  But it sounds like Goliath could potentially win this one . . .

 

 

Taco Bell is going after its much smaller competitor, Taco John's . . . for owning the trademark on the phrase "Taco Tuesday."  

 

 

Taco John's trademarked it in 1989 after they'd already been using it for a few years.  They originally spelled it "T-W-O" for a deal where you got two tacos for 99 cents.  They chose Tuesday because it was their slowest day of the week.

 

 

Yesterday, Taco Bell filed a petition with the trademark office to get it dropped.  They argue that it's a common phrase many people use now, and that the trademark is "absurd."

They said it's like if only one restaurant could use the word "brunch."

 

 

They want Taco John's to drop the trademark so EVERY Mexican restaurant can use the phrase . . . and obviously so Taco Bell can use it too.  For what it's worth, Taco John's HAS gone after other places for using it before.

 

 

According to one expert, Taco Bell might actually have a pretty solid case.  The trademark office sometimes cancels old trademarks for, quote, "phrases that become commonplace."

 

 

Taco John's has 40 days to file a response to the petition.  But it could take up to two years before there's a ruling.
